Filing Requirements

The following requirements are for accessing the NYSCEF website and to view PDF documents within NYSCEF.

Hardware and Software Requirements

NOTE: Microsoft Edge is not supported at this time

The NYSCEF system uses 128-bit encryption to provide you with the highest level of internet security available. To access this site, your browser must support 128-bit encryption and Secure Sockets Layer (SSL) version 2.0 protocol.

Adobe Reader ® or equivalent software to view PDF documents. PDF reader software is free and downloadable from various web-sites. If you don't have the latest version of Adobe Reader ®, Download Adobe Reader now.

Access to a scanner to create images of non-computerized documents such as exhibits.

Terms of Use

  1. I will adhere to the rules governing Electronic Filing in the Uniform Rules for New York State Trial Courts and any protocols promulgated by participating courts.
  2. I am registering so as to be able to employ the NYSCEF live system in cases filed in the courts participating in the NYSCEF program.
  3. I understand that each use of my password for filing documents with NYSCEF constitutes my signature on the document being submitted for the purpose of meeting the requirements of Part 130 of the Rules of the Chief Administrator and all rules governing NYSCEF.
  4. I understand that every filing user must list an e-mail service address. Therefore, as a condition of registering as a filing user of NYSCEF and of receiving my user ID and password, I will provide an e-mail service address. This e-mail service address is the address at which service of interlocutory documents may be made through NYSCEF upon me or upon the parties I represent. If I need to modify my e-mail service address, I shall notify the Resource Center immediately.
  5. I understand that providing any false information in this application may result in a revocation of my authorized user status.
  6. I will protect and secure the confidentiality of my password. If I have reason to believe that my password has been compromised, I will notify the NYSCEF Resource Center immediately by e-mail at EFile@nycourts.gov. I also will inform the court and the Resource Center immediately of any change in my employment affiliation.
  7. This system and all data are the property of the New York State Unified Court System (UCS).
  8. Data may not be mined or sold, or used in any pay-for-use application, without the express written permission of UCS.
  9. This site may not be accessed by any automated program ("bot") for the purpose of extracting data for any use.
  10. This site may not be directly linked to by any website without the express written permission of UCS.
  11. Unauthorized use or attempted unauthorized use of this system may subject you to appropriate disciplinary action and criminal or civil penalties.
  12. Because transcription or other errors may arise when compiling the information provided on this website, users should verify the accuracy of information by consulting original court records or sources. The Unified Court System is not responsible for consequential use of website errors.

Document Submission Requirements

PDF/A
NYSCEF requires that all e-filed documents conform to PDF/A specifications. NYSCEF will not accept documents that contain open action tags or javascript. If these specifications are not met, those documents may not be accepted.

Text Searchable
All PDF documents generated from an original word processing file must be text-searchable and compatible with the latest version of Adobe Reader ®.

Documents created using most modern word processing applications, such as Word, WordPefect and OpenOffice, may be converted to an acceptable PDF format by using an export "save as", or "publish to PDF" function. All of the text in these documents should be searchable in the PDF.

Third-party software is available to convert documents from a word processor format to PDF. There are several of these PDF writer/conversion programs available. You may wish to do an internet search to find a program suitable for your needs.

If a document has any images that contain text, those images may not be searchable. Most document scanners have the ability to scan directly to PDF, and many of them have integrated packages that can make the document text searchable.

If you have a scanned PDF that is not searchable, there are several third party software packages that can make your PDF searchable. You may wish to do an internet search to find a program suitable for your needs.

Security
Documents should not be password-protected or encrypted; documents which include these features violates PDF/A specification compliance.

All documents submitted through NYSCEF, including those marked "secure", will be available for public inspection at the courthouse unless sealed by court order.

Format
Documents submitted via NYSCEF must have one-inch margins at the top, bottom, right and left sides (see Uniform Rule 202.5(a)). The top margin is particularly important to allow space for the addition of County Clerk and NYSCEF filing stamps.

Layers
PDF documents with multiple layers must be flattened prior to submission to ensure that the complete document is available to the examiner.

Object Content
Content that cannot render (be viewed) directly or completely to a printed page, including: multimedia (e.g., sound, video, animations, slideshows), 3-dimensional models (e.g., CAD drawings), file attachments, multi-page objects (e.g., Microsoft Excel spreadsheets, multi-page TIFF images), and commenting/reviewing features (highlighting, annotations, comments, notes, and the like) are prohibited.

Resolution
Required resolution for the scanned PDF images is 200 dots per inch (dpi). Documents scanned at a resolution of 200 (dpi) ensure that the pages of the document are legible both on the computer screen and when printed and, at the same time, minimizes the file size.

File Name
No specific file name is required, but long names will not upload properly.
